Acozz Design – Terms of Service

1. Service Models

1.1 Subscription-Based Web Design
Acozz Design offers a recurring web design service on a subscription basis. This includes unlimited design requests (within fair usage), access to a dedicated project manager, and ongoing support. A 7-day free trial applies to this service only (see Section 4.1).

1.2 Fixed Custom Quote Projects
For clients with specific requirements, Acozz Design provides bespoke services including—but not limited to—website design, development, logo design, branding kits, pitch decks, and marketing assets. Each project is quoted based on scope and deliverables.

1.3 Add-On Services (Domains, Hosting, Email, etc.)
Clients engaging via custom quote may optionally purchase ongoing services through Acozz Design, including:

  • Domain registration and management
  • Web hosting
  • Business email setup and hosting
  • Maintenance or support retainers
  • Additional monthly software or integration fees

These add-ons will be clearly outlined in the project quote and are billed separately on a monthly basis, independent of milestone project payments. Non-payment of these monthly services may result in service suspension. Acozz Design reserves the right to revise pricing for these add-ons with 30 days’ notice.

2. Scope of Work and Communication

2.1 Scope Approval
All design requests must be submitted in writing. Acozz Design reserves the right to refuse or terminate work at any time if a request is deemed outside the agreed scope, unreasonable, inappropriate, or not aligned with our service model.

2.2 Project Abandonment
If a client becomes unresponsive for more than 30 consecutive days during an active project, Acozz Design reserves the right to mark the project as abandoned, retain all payments to date, and terminate the engagement. Reactivation may require an additional fee.

2.3 Revision Policy
Design iterations are limited to reasonable revisions per stage. Excessive revisions or major scope changes may incur additional fees and require timeline adjustments.

2.4 Channels of Communication
Clients may communicate via email or WhatsApp. Key decisions, scope changes, and approvals must be confirmed in writing.

3. Usage Restrictions

3.1 Prohibited Content
Acozz Design will not create or host content that includes:

  • Illegal activity
  • Hate speech or discrimination
  • Adult or explicit content
  • Any other content deemed unethical or inappropriate by Acozz Design

3.2 Non-Circumvention
Clients may not use delivered assets, systems, or insights to recreate our services or contract directly with freelancers involved in the work, without written consent.

3.3 Fair Usage – Subscription Model
Subscription users must adhere to a fair usage policy. Acozz Design reserves the right to limit or pause work if requests become excessive, speculative, or abusive.

4. Free Trial & Cancellation

4.1 Free Trial – Subscription Only
New subscription clients receive a 7-day free trial. During this period, design requests can be submitted. Deliverables are not for commercial use unless the subscription is continued.

4.2 Trial Exclusion for Custom Projects
The 7-day free trial does not apply to custom quote projects. All such projects require an upfront deposit (see Section 5.4).

4.3 Subscription Cancellation
After the trial, subscriptions have a six-month minimum term. Cancellations are not permitted within this period. After six months, cancellations must be submitted 30 days before the next billing cycle via email or Stripe.

4.4 Termination Rights
Acozz Design may terminate services with or without cause by providing written notice. In such cases, unused fees for undelivered work will be refunded, except for non-refundable deposits.

5. Payments

5.1 Subscription Billing
Subscription clients are billed monthly via Stripe following the 7-day trial. Payments are non-refundable once processed.

5.2 Custom Quote Project Billing
Custom project payments can be made via Stripe, PayPal, or Bank Transfer. Invoices will be issued with payment instructions.

5.3 Add-On Monthly Services
Add-on services (e.g. domains, hosting, email) are billed monthly in advance. Failure to pay within 7 days of the due date may result in suspension or termination of these services.

5.4 Payment Milestones – Custom Projects
Unless otherwise agreed in writing, the following structure applies:

  • 25% deposit (non-refundable) at project start
  • 25% at delivery of first design concepts (e.g. first logo or homepage)
  • 50% upon completion, prior to delivery of final files or credentials

5.5 Payment Responsibilities
Clients are responsible for:

  • Keeping billing details accurate
  • Covering transaction fees where applicable
  • Ensuring continued payment for recurring services like domain renewal

6. Intellectual Property

6.1 Subscription Clients
Full IP rights to final deliverables are transferred after six consecutive paid months. All draft work remains the property of Acozz Design.

6.2 Custom Project Clients
Full IP rights are transferred only after full payment has been received. Until then, designs are the property of Acozz Design and may not be used commercially.

6.3 Portfolio Use
Acozz Design reserves the right to showcase completed work in its portfolio, website, or social media, unless agreed otherwise in writing.

7. Limitation of Liability

Acozz Design is not liable for any indirect, incidental, or consequential damages. Our total liability for any claim is limited to the total amount paid by the client for the specific service.

8. Indemnification

Clients agree to indemnify Acozz Design and its team against any third-party claims, liabilities, or expenses arising from misuse of services or breach of these terms.

9. Force Majeure

Acozz Design is not liable for failure or delays caused by events beyond our control, including natural disasters, strikes, internet outages, pandemics, or government restrictions.

10. Governing Law

These Terms are governed by the laws of the United Kingdom. Disputes will be resolved exclusively in the courts of England and Wales.

11. Modifications

We reserve the right to amend these Terms at any time. Changes will be posted on our website and take effect 30 days after posting. Continued use of our services indicates acceptance.

12. Severability

If any part of these Terms is found invalid or unenforceable, the remainder remains in full effect.
